HOW CAN I APPLY FOR THE CRIMINAL RECORD CERTIFICATE IN SPAIN?
If you are not living in Spain, Reuters Solicitors will prepare a document in order to represent you and act on your behalf. We will also pay the Tax and we will submit the documentation to the “Oficina Central de Atención al Ciudadano del Ministerio de Justicia” or to “Gerencia Territorial de Justicia” of each Spanish Region.
WHY IS IT NOT POSSIBLE TO OBTAIN A SPANISH CRIMINAL RECORD WHILE LIVING ABROAD?
As per our experience, it is almost impossible to get the CRIMINAL RECORD CERTIFICATE while living abroad because it is difficult to meet the requirements if you are not base in Spain. For that reason, we recommend you to hire our services.
WHICH IS THE REQUESTED DOCUMENTATION TO ASK FOR A CRIMINAL RECORD CERTIFICATE IN SPAIN?
There are some requirements that must be completed in order to ask for CRIMINAL RECORD CERTIFICATE IN SPAIN:
- Authorization
- Passport copy
- Tax Payment
- Authorization: Also called “Representación Apud Acta”.
The authorization will allow Reuters Solicitors to act on the applicant´s behalf and request the CRIMINAL RECORD CERTIFICATE.
We will draft the authorization and we will email it to the client so he/she can legalize in his/her country.
The authorization should be legalized in front of a Notary, Embassy or Consulate based on the city where the applicant is located.
- Passport copy: It is called “compulsado passport copy”.
In order to obtain the CRIMINAL RECORD CERTIFICATE, a copy of the applicant´s passport should be legalized and stamped by a Notary, Embassy or Consulate.
- Tax Payment: It is called “MODELO 790”.
The modelo 790 should be filled and pay in order to request for CRIMINAL RECORD CERTIFICATE.
In 2022, the tax is 3.86.-€.
The documentation should be sent to “Oficina Central de Atención al Ciudadano del Ministerio de Justicia” or to “Gerencia Territorial de Justicia” of each Spanish Region.
HOW LONG DOES A CRIMINAL CERTIFICATE RECORD TAKE TO GET IT?
It will take 10 working days (approximately) to obtain your certificate since all documentation is submitted to “Oficina Central de Atención al Ciudadano del Ministerio de Justicia”.
NOTE: Once documents are submitted, we cannot assure that the Criminal Record Certificate will be issued in 10 working days. People working at “Oficina Central de Atención al Ciudadano del Ministerio de Justicia” are civil servants.
HOW DOES A CRIMINAL RECORD CERTIFICATE LOOK LIKE?
Once the documentation is submitted to the Spanish Authorities, they will provide the Criminal Record Certificate by post.
The Criminal Record Certificate looks like as follow:
If the country were the Criminal Record Certificate will be submitted belongs to The Hague Convention (list of Countries through this link), you will obtain your Spanish Criminal Record Certificate with the Hague Apostille.
