TEMPORARY RESIDENCY AFTER BREXIT

CAN I GET SPANISH RESIDENCY AFTER BREXIT?

The answer is yes!

If you are a British citizen living in Spain before 31st December 2020, you can apply for Spanish Residency after Brexit and get your TIE Card, if you meet the criteria.

Once you get your TIE Card in Spain under the Withdrawal Agreement, you will be allowed to live in Spain with the same rights as European citizen in Spain.

WHICH ARE THE REQUIREMENTS TO GET SPANISH RESIDENCY AFTER BREXIT?

There are some requirements that you should meet when you apply for your Spanish Residency after Brexit:


  • Live in Spain before 31st December 2020.
  • Passport in force
  • Enough income
  • Healthcare insurance
  • Application form
  • Payment of tax
  • Evidences of living in Spain before 31st December 2020 (i.e.: Padrón municipal, invoices, utility bills, bank statements, credit card statements,)

HOW CAN I SUBMIT SPANISH RESIDENCY AFTER BREXIT?

FIRST STEP: It is necessary to submit the application for Spanish Residency in the Inmigration Office “Oficina de Extranjería” of your “Provincia” together with the requested documentation.

SECOND STEP: After submitting Spanish Residency Application, the Sub-delegation of the Spanish Government (“Subdelegación del Gobierno”) based in your “Provincia” will approve or refuse your application:


If your Spanish Residency Application is approved:

A new appointment to the Police Office (“Comisaría de Policia Nacional”) is needed in order to collect your fingerprints and order your TIE Card.

If your Spanish Residency Application is NOT approved:

Spanish Authorities (“Subdelegación del Gobierno”) will inform you about the document/s you need to amend or rectify in 10 working days.  In this case, you will have to submit them before the end of the 10 working days and wait until Subdelegación del Gobierno approves your Spanish Residency.
Once they approve it, you can make the appointment at the Police Office for the fingerprint and order your TIE Card.

THIRD STEP: Once the fingerprint is done, you will receive a document called “Resguardo de solicitud o renovación de Tarjeta de Extranjero” with will allow you to collect your TIE Card in a month (approx.).

Your TIE Card in Spain under the Withdrawal Agreement will allow you to live in Spain with the same rights as European citizen.

WHAT HAPPENS IF THE SPANISH RESIDENCY IS REFUSED BY SPANISH AUTHORITIES?

Only in the event that Spanish Authorities (“Subdelegación del Gobierno”) denies your Spanish Residency after Brexit, you will be able to submit a Formal Claim called “Recurso de Alzada” to “Subdelegación del Gobierno” of your Spanish “Provincia” in one-month term after their refusal.

We recommend you that you hire the services of a solicitor who writes and submits the “Recurso de Alzada” in order to defend your rights.

WHAT HAPPENS IF “RECURSO DE ALZADA” IS ALSO REFUSED BY SPANISH AUTHORITIES?

Only in same case, “Recurso de Alzada” is also refused by Spanish Authorities, we recommend you not to worry as you will have a last chance to get your Spanish Residency by submitting a Lawsuit at Court.

A solicitor will submit a Lawsuit called “recurso contencioso-administrativo” before the Judge in charge of Administrative Court (“Juzgado Contencioso Adminsitrativo”), who will study your application and will agree with your Spanish Residency, if you meet the requirements settled at Withdrawal Agreement.
